OFFICIAL RULES 

NO PURCHASE NECESSARY TO PARTICIPATE IN THE COMPETITION.

The information on how to participate, the prize, and the rules for claiming the prize are part of the general conditions for participating in the competition. The participation in the competition constitutes acceptance of the Official Rules (the “Official Rules”) and any other notice mentioned herein.

Nothing in this document, nor in any other document related to this competition, shall be construed as obliging the MRC DE MONTMAGNY (hereinafter, the “MRC”) to fulfill its commitments to award a prize* valued at approximately $5000 per winning participant. It is up to the MRC, at its sole discretion, to decide not to proceed with the competition, for reasons it deems relevant or valid. These conditions cannot therefore be interpreted as a contractual commitment; the MRC will only be bound upon signing an engagement contract with the winners, as indicated in clause 10 herein.

In these Official Rules, the term “you” refers to anyone who participates or wishes to participate in the competition.

This competition is part of the MRC’s territorial marketing approach aimed at promoting its territory internationally. Thus, the competition aims to welcome a maximum of 5 winners who will be supported by the region to discover the MRC of Montmagny and its attractions, with the aim of offering a fresh perspective and producing promotional material.

PRIZE*

  1. The winner will receive a prize valued at $5,000 for a 10-night stay (or 12 days, from October 2 to 13, 2024, including welcome days for participants arriving from another time zone to allow them to manage jet lag) detailed as follows:
  • A plane ticket from the winner’s residence, as indicated in their application, to Montmagny, and vice versa (round trip). The landing will be at Jean-Lesage International Airport (YQB), followed by ground transportation from Quebec City Airport to Montmagny, and vice versa for the return to their original residence;
  • A private room in a shared apartment accommodating up to 5 competition finalists;
  • Three (3) meals a day (breakfast-lunch-dinner) provided by the MRC;
  • Transportation and daily activities organized by the MRC to promote the discovery of the territory.

PARTICIPATION CONDITIONS, ELIGIBILITY, AND PRIZE AWARD

  1. The competition is open to citizens of Canada and other countries who are at least eighteen (18) years old at the time of registration and who also meet the requirements set forth herein, including a valid passport (with an expiration date no earlier than February 1, 2025, allowing them to travel).
  1. The competition begins at 4:00 p.m. local time on Wednesday, February 28, 2024, and ends at 11:59 p.m. local time on Sunday, April 21, 2024.
  1. To participate, you must go to the competition registration page at montmagny.com/art-competition-montmagny-direct-flight/ and fill out the form related to the “Montmagny – Direct Flight” competition. You will be asked to provide your full name, address, phone number, and email address. You will also need to answer five (5) questions so that the jury can assess your application.
  1. To receive the prize, the winner must accept the prize within five (5) days of confirmation of winning, and they must also sign a declaration stating that they:
  • meet the eligibility criteria;
  • have read the competition rules and fully comply with them;
  • accept the prize as awarded;
  • comply with all conditions/restrictions applicable to the prize;
  • acknowledge the right of the competition organizer to publish their photo, name, and city of residence without compensation other than the prize offered;
  • and acknowledge the exclusion of liability of the competition organizer, namely the MRC.
  1. By participating, you indicate your full and unconditional acceptance of these official rules, which are final and binding. Winning the prize depends on compliance with all requirements set forth herein.

CRITERIA FOR SELECTING THE WINNER AND ANNOUNCING THEIR IDENTITY

  1. A jury composed of three (3) representatives from the MRC, including one (1) elected official, as well as one (1) representative from the Youth Employment Service and one (1) artist representative from the community, will select a maximum of five (5) winners from all participants and finalists who will be recommended to the MRC council as winners of the competition.
  1. Applications submitted via the form will be analyzed by the jury according to the following 8 selection criteria:
  • Being an amateur artist* and providing a portfolio of practiced art (maximum 2 axes)
  • Being available from October 2 to 13, 2024
  • Demonstrating the ability to live within a group (private room but in shared accommodation)
  • Indicating proficiency in French or English
  • Describing interest in the “Montmagny – Direct Flight” competition
  • Defining why you are the best candidate
  • Describing your most beautiful artistic achievement and why you are proud of it
  • Describing what inspires you about our slogan “Very likely”

*Amateur artist means that the art you practice is not your main profession.

  1. Around June 12, 2024, and once the five (5) finalists have been approved by the MRC council, the 5 finalists will become the competition winners, and they will be officially announced by the jury. This will be broadcasted on the MRC website and the Montmagny Region Facebook page.
  2. A representative of the MRC will send an email to the winner’s email address with instructions on how to claim their prize, including signing an agreement, which must be signed within the deadlines indicated by the MRC.
  3. The winners’ identities will also be published on the websites montmagny.com and montmagny.com/art-competition-montmagny-direct-flight/
  4. The prize must be accepted as awarded and is not transferable, assignable, or convertible to cash.
  5. At the end of their stay in Quebec, around October 10, 2024, the winning finalists must deliver their artistic work(s) inspired by the territory of the MRC of Montmagny during the days of visits organized by the MRC. Among the works delivered, the public will be invited to vote online for the most inspiring work related to the slogan “Very likely”. The artist who receives the most votes will be the winner of the adventure. They will be awarded a gift certificate worth $1,500 for a travel credit in our MRC (purchased from a local merchant via a gift certificate from the Economic Development Corporation (SDE) of the MRC of Montmagny). For example, purchases for accommodations, restaurants, tourist visits, etc. The winner will have 18 months to benefit from their gift certificate.

GENERAL CONDITIONS

  1. Without limiting the generality of the foregoing, the following general conditions apply to the competition:
  • In the event of the winner’s failure to comply with the commitments they have undertaken for the realization of their artistic project in accordance with the terms of the competition, the MRC of Montmagny may terminate the agreement without further notice after the first notice of non-compliance;
  • The prize must be accepted as awarded and is not transferable, assignable, or convertible to cash;
  • In the event that the operation, security, or administration of the competition is compromised in any way, including, but not limited to, fraud, a virus, or any other technical problem, the MRC may, at its discretion:
    • Suspend the competition to remedy the deficiency and resume the competition in the manner most consistent with the spirit of these Official Rules;
    • Award the prize randomly from among the eligible entries received up to the time of the deficiency.
  • Any attempt by anyone to undermine the legitimate operation of the competition may constitute a violation of criminal and civil law, and if such an attempt is made, the MRC reserves itself the right to seek damages from that person to the fullest extent permitted by law.
  • The competition is subject to local, provincial, and federal laws and regulations and is void where prohibited.
  1. Any information collected in connection with the competition will be used only in accordance with the consent given by participants when registering for the competition. Each participant therefore agrees, by registering for the competition, that their personal information (only their name and city of residence at the time of submitting their application) may be disclosed for the purpose of informing the public and other participants of the competition winner. Thus, the following information will be obtained from each participant for the administration of the competition and may also be used by the MRC, its officers, directors, and employees to communicate with the winner:
  • First name and last name
  • Address;
  • Phone number;
  • Email address.

Participants have the right to access, modify, and withdraw their personal data.

  1. By participating in the competition, participants agree to release the MRC and their respective officers, directors, employees, and agents from any claim or cause of action arising from participation in the competition or the receipt or use of a prize, including, but not limited to:
  • Unauthorized human intervention in the competition;
  • Technical errors related to computers, servers, providers, or network lines;
  • Printing errors;
  • Lost, late, postage-due, misdirected, or undeliverable mail;
  • Errors in the administration of the competition or the processing of entries; or
  • Injuries or damages to persons or property that may be caused, directly or indirectly, in whole or in part, by a participant’s participation in the competition or the receipt or use of a prize.
  1. If the 5 winning finalists: (a) fail to return the completed competition documents within the specified time frame; (b) cannot or do not want to accept the prize (as is), for any reason, and therefore, sign the contract provided in clause 10; and/or (c) are deemed to be in violation of these Official Rules (fully determined by the MRC in its sole and absolute discretion), then they may, at the sole and absolute discretion of the MRC, be disqualified; (and in case of disqualification, they will forfeit all rights related to the prize.).
  1. The MRC reserves the right, at its sole and absolute discretion and, if time permits, to randomly select another eligible participant from the remaining eligible entries submitted and received during the applicable entry period (in which case the preceding provisions of this section will apply to this newly selected winner on July 1, 2024, or any other timeframe set by the MRC). This newly selected winner will be notified by email within three (3) business days of the selection, using the contact information provided by that person when registering for the competition.
  1. A limit of one (1) entry per person applies to each of the competitions, namely, the one covered by this notice and the one concerning “Montmagny – Direct Flight”. Multiple entries will not be recognized, in which case, all such entries may be rejected unless one or the other of the registered persons withdraws their entry in one or the other of these competitions. For the purposes hereof, each participant must have their own email address (no shared email address).
